WHAT IS TRADEMARK RENEWAL

Trademark renewal refers to the process of renewing the trademark for further 10 years. It preserves rights which are only available to a registered mark. Trademark renewal is required to be done in every 10 years along with the payment of prescribed fee. In case the proprietor fails to renew the trademark, then he shall lose all the protection that comes along with registration.

TRADEMARK RENEWAL PERIOD
  • Before six months of expiry – The Renewal is to be filled before six months prior to the date of expiry on receiving electronically generated notice of registry intimation of expiry of trademark application. No additional fees is charged.
  • Within Six Months Of Expiration – The renewal application can be filed within six months after the expiry of renewal along with late filing fees of Rs. 4500/-.
  • After Six Months Of Expiration – The renewal application can also be filed after six months from the date of expiration of the last registration of the mark. However such renewal must be done within one year from the expiry with late filing fees of Rs. 9000/-.
CONSEQUENCES OF NON-RENEWAL OR DELAYED RENEWAL

In the event of any delay after six months and within one year of expiration of trademark shall be risky and will attract more fees. In case if renewal is not completed within prescribed time period then it will lead to abandoned i.e. removed from the trademark register. After the trademark gets expires or abandoned, it will be available in the public domain.
